- What are your rights?
As a data subject, you have a number of rights with regard to your personal data. These are described below.
| Right | Description |
| The right to information | This right is described in this document. |
| The right of access | You can always send us a request to view all the data we have stored or to obtain a copy of it in a readable format. When you request this information, clearXperts will provide you with all the necessary information, such as: the processing operations, the retention period, the legal basis for processing and the recipients. To ensure that the request for access has been made by you, we ask you to send a copy of your identity document with the request. In this copy, black out your passport photo, MRZ (machine readable zone, the strip with numbers at the bottom of the passport), passport number and national registration number. This is to protect your privacy. This information will be sent to you within a month. |
| Right to rectification | You have the right to have any personal data we process about you corrected if you know or suspect that it is incorrect. clearXperts will correct this as soon as possible. |
| Right to object | You have the right to object to any processing of your personal data for which we believe we have a legitimate interest. The processing of the personal data in question will be discontinued, unless we can demonstrate compelling legitimate grounds for this processing that outweigh your interests, rights and freedoms, or if this personal data is related to the establishment, exercise or defence of legal claims. |
| Right to erasure | If you no longer wish clearXperts to process your personal data, you can send an email to clearXperts requesting that this data be deleted from our files/databases. However, this right is not an absolute right and you should bear in mind that other legislation may restrict this right. For example, you cannot request the deletion of data for which a legal retention period has been set and this retention period has not yet been reached. All personal data that we process about you on the basis of “consent” can be deleted immediately when you withdraw your consent. This can be done by simply sending an email to [email protected]. However, if there are ongoing disputes, e.g. a court case or other discussion that may have legal consequences, our interest in retaining this data outweighs your right to deletion. As long as such activities are ongoing, we cannot delete any data. |
| Right to restriction of processing | If you disagree with one or more of the processing operations that clearXperts performs on your data, you can invoke a restriction. This can be done by sending a simple request to [email protected]. |
